home cash game argument

Hello there poker fans!
So my poker friends and I were having a cash game and a situation occured that made alot of us unshure and argumentive over the problem.
I was hoping someone may know the correct way to solve the problem if it is to occur.
I would appreciate your comments and hope to get the right answer for the problem.

So the shuffle happens than the cut and dealing commences.
Betting know begins pre flop and than the flop comes out.
In the flop there is know a cut card for the last card for the flop instead of a regular card.
Now is the action that has started dead? We shuffled with 53 cards instead of 52 but action has already began....players want to continue but I did not think we should, we started this hand with the cut card involved in the deck. Does anyone have a regulation answer to help this situation. much appreciated.

You discard the cut card and play on no harm no foul.

The proper way is you leave the burn as is...reshuffle, cut, then deal a flop not burning a card. Just flip over 3 cards like you would if you had burned already

3. If a card with a different color back appears during a hand, all action is void and all chips in the pot are returned to the respective bettors. If a card with a different color back is discovered in the stub, all action stands.

8. A joker that appears in a game where it is not used is treated as a scrap of paper. Discovery of a joker does not cause a misdeal. If the joker is discovered before a player acts on his or her hand, it is replaced as in the previous rule. If the player does not call attention to the joker before acting, then the player has a dead hand

Not quite sure which one applies here though??? good luck deciding

I would think though, just remove cut card and use next card.

Henry is right..

the bad card is removed... the 2 other cards resuffled into the deck and the flop redone.
